Misdemeanor Theft Charges
In Indiana, a theft crime is charged as a Class A Misdemeanor if the person took unauthorized control over another person’s property with the intent to return it at a later time. But rather than referring to this as misdemeanor theft, Indiana classifies these crimes as criminal conversions. Those convicted face up to 1 year in jail, up to $5,000 in fines, and additional court-ordered penalties.
Felony Theft Charges
In Indiana, a theft crime is committed when a person takes unauthorized control over another person’s property with the intent to deprive. These crimes are charged as Level 6 Felonies, but can increase to a Level 5 Felony depending on certain elements of the crime. Stealing a car would be a Level 5 Felony theft crime.
Penalties for Theft
Class A Misdemeanor
Generally charged as criminal conversion and not theft, shoplifting is a Class A Misdemeanor if the total value of the stolen merchandise is under a certain dollar amount. This imprecise dollar amount is at the discretion of the prosecutors and will vary depending on a person’s criminal history and the unique circumstances of the case. It is punishable by up to 1 year in jail and up to $5,000 in fines.
Level 6 Felony
If the total combined value of the stolen merchandise is less than $49,999 then it is charged as a Level 6 Felony, punishable by 1 to 3 years in prison, and up to $10,000 in fines.
Level 5 Felony
If the total value of the stolen merchandise is $50,000 or more, then it is charged as a Level 5 Felony, punishable by 2 to 8 years in prison, and up to $10,000 in fines.
